Overview
This Planning Proposal seeks to amend the Dubbo Regional Local Environmental Plan 2022 (Dubbo Regional LEP 2022) to make advertising structures prohibited in the E4 General Industrial zone.
Before the NSW Government’s Employment Zone Reforms were introduced in April 2023, advertising structures were permitted with consent in the IN1 General Industrial zone (Wellington) and prohibited in the IN2 Light Industrial zone (Dubbo). When these zones were consolidated into the E4 General Industrial zone, advertising structures became permitted with consent across this land within the Local Government Area.
This outcome is inconsistent with Council’s long‑standing policy position, which limits advertising signage to the land on which the associated business activity operates. The current permissibility of advertising structures in the E4 General Industrial zone is therefore considered an anomaly that this Planning Proposal seeks to correct.

Submission Process
In accordance with the Personal Information Protection Act 1998, written submissions received by Council containing personal information may be made public when the matter goes before Council for consideration, as it may be included in Council’s Business Papers. Persons have the right to remain anonymous if they so choose by refraining from submitting their personal information, however, the submission may be given less weight in the overall assessment and consideration of the draft Planning Proposal.

A Planning Proposal is a document that explains the intended effect of, and justification for, a proposed amendment to the Dubbo Regional Local Environmental Plan 2022. A Planning Proposal can be prepared by a proponent, however, it must be endorsed by Council and the NSW Government Department of Planning and Environment in order to take effect. This process must be undertaken in accordance with Division 3.4 of the Environmental Planning and Assessment Act 1979.
The six keys stages for amending the Dubbo Regional Local Environmental Plan 2022 are:
- Stage 1 – Pre-lodgement;
- Stage 2 – Lodgement and assessment;
- Stage 3 – Gateway Determination;
- Stage 4 – Post Gateway (current stage);
- Stage 5 – Public exhibition and assessment; and
- Stage 6 – Finalisation

The Dubbo Regional Local Environmental Plan 2022 is a statutory document that guides land use planning and development in the Dubbo Regional Local Government Area. It includes specific controls and provisions that regulate land use and development, such as zoning, minimum lot sizes, development standards, land use permissibility and environmental heritage.
