Background
Since December 2019, Dubbo Regional Council has managed the closure of Council-owned roads under the Roads Act 1993. A road may be closed if it is not needed for public use or doesn’t link to the road network, and alternative access is available. To close a road, it must be subdivided, requiring a Subdivision Certificate from NSW Land Registry Services. However, if the new lot area deviates by more than 10% from the Minimum Lot Size Area in the Dubbo Regional Local Environmental Plan 2022, Council endorsement is needed. This endorsement can potentially cause delays.
Overview
This Planning Proposal aims to streamline the road closure process by amending the Dubbo Regional Local Environmental Plan 2022. It seeks to classify the subdivision of Council-owned roads for the purpose of closure as exempt development. If this amendment isn’t supported, an alternative adjustment will exempt these subdivisions from the Minimum Lot Size Area requirement, removing the need for additional Council endorsement.
Our community are encouraged to have their say on the Planning Proposal which will be on public exhibition until 9am, Monday 16 September 2024.A Planning Proposal is a document that explains the intended effect of, and justification for, a proposed amendment to the Dubbo Regional Local Environmental Plan 2022. A Planning Proposal can be prepared by a proponent, however, it must be endorsed by Council and the NSW Government Department of Planning and Environment in order to take effect. This process must be undertaken in accordance with Division 3.4 of the Environmental Planning and Assessment Act 1979.
The six keys stages for amending the Dubbo Regional Local Environmental Plan 2022 are:
- Stage 1 – Pre-lodgement;
- Stage 2 – Lodgement and assessment;
- Stage 3 – Gateway Determination;
- Stage 4 – Post Gateway;
- Stage 5 – Public exhibition and assessment (current stage); and
- Stage 6 – Finalisation
The Dubbo Regional Local Environmental Plan 2022 is a statutory document that guides land use planning and development in the Dubbo Regional Local Government Area. It includes specific controls and provisions that regulate land use and development, such as zoning, minimum lot sizes, development standards, land use permissibility and environmental heritage.

In accordance with the Personal Information Protection Act 1998, written submissions received by Council containing personal information may be made public when the matter goes before Council for consideration, as it may be included in Council’s Business Papers. Persons have the right to remain anonymous if they so choose by refraining from submitting their personal information, however, the submission may be given less weight in the overall assessment and consideration of the Planning Proposal.
